A police corporal was charged in the sessions court here today in connection with the shooting death of teenager Aminulrasyid Amzah (pix) during a car chase here last month.
Corporal Jenain Subi, 48, pleaded not guilty before judge M.Gunalan to causing the death of Aminulrasyid, 15, in Jalan Tarian 11/2, Section 11, between 1.10am and 2am on April 26.
If convicted, he faces up to 30 years in jail and liability of a fine.
Clad in blue jeans and a yellow and organge T-shirt, he was taken to the court complex at 11.30am.
Asked by the judge whether Jenain was still in service, deputy public prosecutor Mohd Dusuki Mokhtar said he was.
Dusuki asked for bail of RM35,000 with one surety but defence counsel Salim Bashir asked for the amount to be fixed at between RM6,000 and RM7,000, saying that Jenain earned only RM3,000 a month while his teacher wife made RM1,800 a month and they had to support four young children.
He said that bail was imposed to secure attendance and not to punish and as Jenain was still a policeman, he had no opportunity to abscond.
If Jenain could not post the bail, he would be remanded until the disposal of the case, he added.
He also asked the court not to be swayed by public views and sentiments on the case because a person was innocent until proven guilty.
Dusuki, however, submitted that the offence was a serious one to the extent that Parliament had passed an amendment to increase the maximum penalty to 30 years, from 20.
The bail was not only to ensure attendance at the trial but also in the public interest, he said.
Gunalan fixed June 10 for mention and set bail at RM10,000 with one surety after taking into account Jenain's financial status and the fact that he was still a policeman.
Jenain, from Sabah, joined the police force in 1985. He was a member of the Shah Alam police patrol squad at the time of the alleged incident.
