Court to decide on Bung Moktar's appeal on Thursday-1 month jail and fine for marrying without consent from 1st wife.
The Syariah High Court here will decide on Thursday the appeal filed by Kinabatangan Member of Parliament (MP) Datuk Bung Moktar Radin and actress Zizie Izette A.Samad to seek acceptance and registration of their marriage by the Federal Territories Marriage, Divorce and Reconciliation Registrar.
The appeal was filed in line with Section 12 (2) of the Islamic Family Law (Federal Territories) Act 1984 (Act 303).
Syarie Senior Judge Mohd Abdul Radzi Abdul Latif today heard the testimonies from Bung Moktar, 51, Zizie, 32, and her brother who acted as the 'wali' (guardian), Ahmad Shahazami, 48, and her two other siblings (as witnesses), Samzy Fuzette, 34 and Shaheizy Sam, 28.
The proceedings were held in chambers.
Speaking to reporters later, lawyer Zulkifli Che Yong, who represented both Bung Moktar and Zizie, said the two had filed the appeal on June 4.
When asked why the appeal was filed at the High Court here despite the wedding solemnisation being done in Taman Melati, Selangor, Zulkifli said: "When the appeal was filed, Zizie has moved to Kuala Lumpur and the appeal must be filed according to her residential address."
Before the proceedings started, Zizie and Bung Moktar appeared shocked at the presence of reporters at the court and her brothers also refused to make any comment.
Nevertheless, Bung Moktar jokingly said that his presence was only "to meet a friend in court".
On May 19, the MP was sentenced to one month's jail by Gombak Timur Syariah Lower Court for committing polygamy without the court's permission last year.
Syarie Judge Wan Mahyuddin Wan Muhammad however allowed a stay of execution on Bung Moktar who was granted RM1,000 bail with one surety pending appeal.
Bung Moktar was also fined RM1,000 in default one month's jail for abetting Zizie to marry without consent of the Registrar of Marriage, Divorce and Reconciliation at the same place, time and date.
Zizie was also fined RM1,000 in default one month's jail for marrying Bung Moktar without consent of the Registrar of Marriage, Divorce and Reconciliation at the same place, time and date.
The popular actress who was charged under Section 40 (2) of the Selangor Islamic Family Law Enactment 2003 was also fined RM1,000 in default six month's jail for abetting Bung Mokhtar in committing polygamy without consent of the court.
