Blacklisted trader sues bank for RM3m damages


A trader is suing Malayan Banking Berhad (Maybank) for its alleged negligence claiming Bank Negara Malaysia (BNM) blacklisted him as a "defaulter" even though he had fully settled his credit card debt with the bank.

Musa Bakar Mydinsah, 38, of Seri Kembangan here, filed the suit at the Civil High Court registry here today via the law firm of Messrs A S Dhaliwal.

In his statement of claim, Musa Bakar stated that he had settled and closed his credit card account with the bank in Sept 2006.



His "blacklisted" status only came to light in 2009 when his application for a car loan with CIMB Bank Berhad was declined.


He added that a check with BNM revealed his name was blacklisted effective July 1, 2008, two years after he had made full payment.

Musa Bakar said Maybank insisted that the 2006 payment was not in order which led them to blacklist him.

The plaintiff claimed the bank's negligence caused his car and business loans to be declined.

He also contended that the defendant failed to notify him of its action and that a letter of demand for compensation led the bank to remove his name from the blacklist, which was tantamount to an acknowledgment of its mistake.

Musa Bakar is seeking RM1 million in general damages and RM2 million in exemplary and aggravated damages
