Agreed to an EGM , will exchange EGM agenda between chua and Ong . Disipline committee is lookout for bribery used in petition for EGM.

MCA secretary-general Datuk Wong Foon Meng meet with Datuk Seri Tan Chai Ho the EGM chief coordinator for Dr Chua. Both has now agree to have a single EGM known as the Presidential EGM. Both parties are hopely will meet to fix the date for the EGM.

Datuk Seri Tan Chai Ho EGM action committee chief coordinator

Dr Liow and Kong are seen as replacement for the Ong and Chua , if Ong and Chua voluntary resign for the sake of unity in MCA.

The leaders of a campaign to topple Datuk Seri Ong Tee Keat as MCA president met with the party secretary general to explore the possibility of combining their extraordinary general meeting (EGM) with a competing one called by Ong himself.

This comes after MCA secretary general Datuk Wong Foon Meng tried to avert a two EGM scenario and gave supporters of sacked deputy president Datuk Chua Soi Lek until today to submit their EGM agenda saying that two EGMs would be a waste of party resources and delegate’s time.

The deadline was extended indefinitely following the meeting between Datuk Seri Tan Chai Ho, who is chief coordinator of the campaign, and Wong.

Tan, who came with a copy of the five resolutions of what has been called the central delegate’s EGM, had wanted to exchange agendas with what is now called the president’s EGM.

MCA secretary-general Datuk Wong Foon Meng today announced that both party president Datuk Seri Ong Tee Keat and deputy president Datuk Seri Dr Chua Soi Lek's camps had agreed to a joint extraordinary general meeting.

Supporters of sacked MCA deputy president Datuk Seri Dr Chua Soi Lek want the party president, Datuk Seri Ong Tee Keat, to propose a date for the next meeting between the two warring factions to discuss matters pertaining to a single Extraordinary General Meeting (EGM).

It was learned that Ong's resolutions will include the central delegates' endorsement of the decision to expel Chua and also to support Ong in getting to the bottom of the Port Klang Free Zone (PKFZ) scandal.

It was reported that the committee has two major resolutions for the EGM, which were to:
> Reinstate Chua as the deputy president; and
> Move a motion of no-confidence against Ong.

Earlier Tan told reporters the discussion with Wong did not take place because the action committee wanted to read Ong's resolutions before submitting its resolutions to the party headquarters.

"We would like to thank Wong for meeting us but we can only discuss when the president's resolutions are ready. To be fair, it is better for us to read the resolutions together. We will decide on the possibility to hold the EGM together after going through the president's resolutions and we hope that Ong will sit down and talk to us," he said, adding that another date will be fixed for the discussion.

Asked how many resolutions have been drafted by the committee, Tan said he will only make public the resolutions after discussion with party headquarters.

On whether the committee has an ideal date for the EGM, he said he was unable to say, but that it shall be decided by the secretary-general after the committee has officially submitted the petition for an EGM.

"We are ready to submit the petition anytime as we have collected more than 800 signatures and we will continue to receive signatures from the central delegates," he said.

On the accusation that some central delegates were forced to sign the petition, Tan said the delegates signed voluntarily after reading the resolutions and witnessed by lawyers and oath commissioners.

MCA Disciplinary Board Asked To Be On Lookout For Money Politics

MCA president Datuk Seri Ong Tee Keat wants the party's disciplinary board to be on the lookout for money politics ahead of its extraordinary general meeting (EGM).

The Transport Minister said MCA viewed the matter seriously and would not compromise on money politics in whatever form.

"Perhaps our disciplinary board or MCA's secretariat can follow up on this. We cannot compromise on any kind of graft or commonly known as money politics," he told reporters after holding a meeting with Pahang MCA members here Saturday.

Prior to this, MCA secretary-general Datuk Wong Foon Meng had stated that there had been numerous complaints from the grassroots alleging "signatures were being bought" for the convening of a rival party EGM.

Central Delegates lobby to replace Ong and Chua with Liow and Kong

Sin Chew Daily recently found that some MCA Central delegates have started to lobby other Central delegates to quell the current dispute and internal conflict by asking President Datuk Seri Ong Tee Keat and Deputy President Datuk Seri Dr Chua Soi Lek to resign, and electing successors to replace them.

It is reported that these Central delegates reflect the current idea of the grass-roots in which they support neither Ong nor Dr Chua. They believe that the current situation of the party is derived from the hatred between Ong and Dr Chua instead of the whole leadership. Also, they do not wish the hatred to cause another unnecessary party struggle and split.

It is understood that these Central delegates are trying to contact and propose the idea to other Central delegates who tend to support the Chua faction. They lobby them to persuade Dr Chua to accept the proposal.

It is said that they believe that if both Ong and Dr Chua step down, the Central Committee will elect the most suitable candidates to be their successors.

Among the four Vice-Presidents, namely Datuk Kong Cho Ha, Datuk Seri Dr Liow Tiong Lai, Datuk Seri Dr Ng Yen Yen and Tan Kok Hong, Kong and Dr Liow(the current Minister of Health of Malalysia ) are most likely to be elected as the successors.

It is said that the Central delegates, who tend to support the Chua faction, have not yet given any response to the proposal, but they wonder whether Ong is willing to step down. They believe that in order to have both Ong and Dr Chua resign, they must first have Dr Chua back to the party for discussions and negotiations.

A MCA veteran pointed out that there are only two options available for MCA now. Firstly, they have to choose between Ong and Dr Chua; secondly, both of Ong and Dr Chua have to resign.

Hindu Temple relocation shelved after chaotic town hall meet -Emotional charged free for all hurling insults.

Pix show the section 23 Shah Alam marching to the Secretariat with a cow head. Cow are sacred to the Hindu in Malaysia.

The act of stepping on the cow head.

Parading a cow head.

Putting a cow head in the entrance of the Secteriat.

The town hall meeting on the temple relocation issue degenerated into a verbal free-for-all.Seat are the Shah Alam mayor Mazalan Md Noor , Menteri Besar Selangor , Shah Alam MP Khalid Samad,Batu Tiga state assemblyman Rodziah Ismail.

Tension were high in the town hall as 2 parties clashes over the relocation of an Hindu Temple in the majority Muslim Malay area section 23. Is this Malay/Muslim sentivities or pure racism.

Menteri Besar Selangor Khalid has call off the relocation of the temple following today's incident laden town hall meeting. Where both sides where hurling insults and no solution were found.

Residents of section 23 Shah Alam were very emotional charged and it was free for all hurling insults and each other , those who support and those who against the relocation of the temple.

Some 30 to 40 Indian residents of Section 23 have made themselve heard at the town hall meetings. They are speaking out to support the relocation of Sri Mahamariamman Temple in section 23.

Little were discussed as the same group in the cow head protest prevented any discussions instead hurling insults and disrupting the town hall meeting.

MBSA officers step in to separate protesters as arguments become heated at the town hall meeting. Menteri Besar Khalid were trying to calm the protestors.Later with no solution found Khalid decided to postpone the relocation of the temple to section 23 Shah Alam.

“Muslim sensitivities” was used by the Malay residents of Section 23 as the central reason to reject the Hindu temple relocation, but when some were asked today what these “sensitivities” really were, none of them could give a straight answer.

One Malay lady said it will cause traffic jam. Another Malay guy said they do not like the smells and temple will only get bigger.

Some said , too many temples will made Malay uneasy and such.Yet Malay residents of Section 23 said they felt their religion, Islam, had been profoundly threatened by the temple relocation proposal by the Selangor Pakatan Rakyat government.

It prompted them to take to the streets with a cow’s head recently to defend their religion; it drove them to discard civic consciousness and adopt extreme measures, to go as far as insulting another religion, knowing full well such action could lead to physical confrontations.

Proceedings barely got off the ground before the protesters started shouting and booing at Khalid, along with Khalid Samad (MP for Shah Alam), and Shah Alam mayor Mazalan Md Noor.

Despite calls for calm, the ruckus continued with the upset residents yelling “Penipu!” (liar!) and “Bodoh!” (stupid!) each time Khalid attempted to address them.

Tempers frayed at one point, with rowdy protesters standing on their chairs while shouting.

One Indian Section 23 resident confronted a cow-head protester, prompting MBSA enforcement officers to step in to defuse the situation.

Tensions appeared to ease after that, but the protesters started to get worked up again when Batu Tiga state assemblyman Rodziah Ismail took to the podium. The residents accused her of ignoring their views when planning the relocation of the temple, pelting her with shouts of “Tipu!”

Khalid Ibrahim has said the state government will now reconsider the location of the temple, and that the state development board (PKNS) would need to come up with an amicable solution. This did not placate the irate residents any.

With no clear outcome possible from the emotionally-charged meet, aides led the mentri besar away. The meeting ended with the situation exactly as it was, with no resolution in sight.

Last Friday, a group of 50 protesters from the Section 23 area in Shah Alam held a demonstration in front of the state secretariat building to protest the planned relocation of the 150-year-old Sri Mahamariamman Temple to Section 23 from Section 19. They brandished a severed head of a cow at the protest.

The 150-year-old temple was built on a plantation which over the years was developed into housing estates by the Selangor Development Corporation (PKNS). No provisions were made to relocate the temple, which is now in the middle of a Muslim majority area.

--------------------

A total of 211 residents from Section 23 attended the meeting at the Shah Alam City Council (MBSA) auditorium and more than one third noisily expressed their objections to the temple and refused to even listen to explanations from the mayor, representatives of the Selangor Development Corporation (PKNS) and the state government.

Khalid Samad also lashed out at Datuk Seri Khir Toyo for continuing to propose all temples in Shah Alam to be relocated to a cluster site in Section 18.

The previous state government had spent RM600,000 to prepare the site meant for seven temples but the idea failed to take off because the temple committees had rejected the idea.

Khalid said the previous state government had first prepared the site, then attempted to arm twist these temple committees to move.

“If I was Dr Khir, I would be ashamed to admit that I have spent so much money without solving the issue.”

Deputy Prime Minister Muhyiddin offers to mediate in Terengganu Umno feud

Former Menteri Besar of Terengganu Idris , not supported by the palace/state rulers. Once Ahmad was elected, Idris supporters were sidelined and accused of bribery. Maybe be due to the controversial too lavish in the Crystal mosque and Monsoon cup expenses , where the people think is better spent to reduce poverty and flood prevention. Monsoon cup cost RM300 million per year to host. The Crystal Mosque cost RM240 million .

Current Menteri Besar Ahmad of Terengganu facing crisis , maybe around lost 9 seats to cross over to opposition. Here in Pixture praying hard in Mosque. Face boycott in state assembly and in state functions. Royal Palace opposed his nomination by UMNO hq. Ahmad got support of the royal palace.

Ahmad Said’s (centre) rift with some Umno representatives has grown into talks of defections.
PM Najib(left)

Umno deputy president Tan Sri Muhyiddin Yassin harbours high hope that Umno leaders in Terengganu could accept the fact that they should be together and remain united to serve the people.A fresh political storm is brewing in Terengganu, with rumours that nine Umno assemblymen are threatening to defect as a result of a longstanding feud with the state’s mentri besar.

If the nine join forces with opposition Pakatan Rakyat’s (PR) eight Parti Islam SeMalaysia (PAS) assemblymen in Terengganu, the Barisan Nasional (BN) state government would fall. At present, BN has 24 of the 32 state seats, with Umno holding 23 of the BN seats and the Malaysian Chinese Association (MCA) taking the remaining seat.

Muhyiddin, who is also Deputy Prime Minister and Barisan Nasional deputy chairman, said he believed the state leaders were true and loyal Umno supporters. "There could be some moves by some parties to draw them in but I believe they understand better since they are very experienced and matured."

He said he did not know of rumours that nine Umno assemblymen had threatened to defect as a result of a longstanding feud with the menteri besar, Datuk Seri Ahmad Said.

Muhyiddin also expressed hope that the situation in the state under the chairmanship of Umno vice-president Datuk Seri Hishammuddin Hussein would improve.

Ahmad, who is now Umno Terengganu deputy chairman, is facing rebellion within the state party set-up.

At least 12 of the 23 Umno assemblymen are said to be against his leadership.

The state has long been shaky after the state ruler rejected Umno’s choice of mentri besar, the incumbent Idris Jusoh, and appointed Datuk Ahmad Said following the general election in March last year.

Several Umno leaders and supporters had held protests, leading to a brief constitutional crisis and an uncomfortable stand-off between the party and the palace. Then-prime minister Abdullah Badawi was forced to back down.

Since then, Idris’ supporters say that they have been sidelined by Ahmad and it seems they are unhappy because they were denied positions in the state Cabinet and were not handed state projects. In April this year, a group of 10 Umno assemblymen boycotted a sitting of the state assembly amid rumours that a motion of no confidence would be tabled against Ahmad.

Prime Minister Najib Razak had to intervene, and he ordered them to return to the proceedings.

Although the menteri besar claimed otherwise last week, political observers believe the numbers could grow in the coming months if nothing was done to resolve the differences.

Umno holds 23 seats in the state assembly. MCA has one and Pas eight.

Hishammuddin also expressed his gratitude to Deputy Prime Minister Tan Sri Muhyiddin Yassin for his willingness to be a mediator in resolving the internal crisis in Terengganu Umno.

“He can help resolve one or two of the problems while the mentri besar and I can resolve the rest of it.

“We will do this quietly and directly with the leaders involved,” he said.

Muhyiddin, who is Umno deputy president, was in Terengganu yesterday to meet state Umno leaders and offered to help Hishammuddin to resolve the problem.

When asked about several BN assemblymen who were not presence at the meeting with Muhyiddin yesterday, Hishammuddin said it was because the deputy prime minister had three events in the state.

“I was told that almost all of them were present at the events,” he said.

Kg Buah Pala: It’s a done deal ... just about

Down it comes: A couple of workers from the developer’s office demolishing one of the houses in Kampung Buah Pala.

Final decision: Lawyer Darshan Singh Khaira (third from left) and former ISA detainee P. Uthayakumar (third from right) speaking to Kampung Buah Pala residents outside the courtroom in Putrajaya Friday. The people have vacate their kg. The land sell is legal.

Rising tension: Ho (right) being surrounded by Kg Buah Pala supporters and residents over the demolition of a house in the village. Nusmetro director Gary Ho at the far right corner.

The 11 remaining temporary occupation licence (TOL) holders of Kampung Buah Pala now want to accept the developer’s double-storey house offer.

They have asked to be given the ex-gratia offer -- which was taken up by the other holders -- again during a meeting on Wednesday night, said developer Nusmetro Ventures (P) Sdn Bhd executive director Thomas Chan.

The meeting was attended by Chan, the village committee members and representatives of landowner Koperasi Pegawai Kerajaan Negeri Pulau Pinang. In an immediate response, residents association chairman M. Sugumaran, one of the 11 TOL holders yet to sign on the ex-gratia deal, said they had always wanted to accept the offer -- provided terms and conditions were fully spelled out in black and white.

“We will probably arrange a meeting for them with the state government tomorrow (Saturday). A lot will depend from the outcome of the negotiation before we can build additional houses,” he said. Initial 24 house now 33 house. Additional house will require approval from government.

He added they could seek assistance from deputy Chief Minister II Dr P. Ramasamy, who is in charge of the matter.

He said they would submit a new development plan by next week.

“Once it is approved, we anticipate the 33 houses to be ready in two years time,” he said.

Chan also said the state government had set a bad precedent over the Kampung Buah Pala land issue by raising the expectation of squatters in Penang.

“It is no longer a RM75,000 low-medium cost house that they want as settlement. They want double-storey houses now.

“This move has create issues in several areas like Tanjung Tokong and Mak Mandin where squatters are expecting more from the developers or land owners,” he said.

Chan said the demolition of houses at the village will continue on Saturday. He hoped there would not be any more repeat of Thursday’s high drama, when police detained 18 people, of whom only five were from the village. They were later released on police bail.

Malaysia's first ever submarine arrives to acclaim

The European-made Scorpene submarine is the first of two commissioned for a combined total of $961 mln

Malaysia's first submarine KD Tunku Abdul Rahman docked at Port Klang after its arrival this morning.

Malaysia's first submarine KD Tunku Abdul Rahman docked at Port Klang after its arrival this morning.

Malaysia's first ever submarine was delivered Thursday to colourful fanfare and a royal visitor, in an acquisition that the government said "completes" the country's navy.

The European-made Scorpene submarine is the first of two commissioned from French contractor DCNS and Spain's Navantia for a combined total of 3.4 billion ringgit (961 million dollars).

The second submarine is scheduled for delivery in late 2009.

The KD Tunku Abdul Rahman, named after the nation's first prime minister, sailed into a grand reception at the navy's deepwater Pulau Indah base in Port Klang, an hour's drive from the capital Kuala Lumpur.

Malaysian King Tuanku Mizan Zainal Abidin was given a tour of the submarine, which set sail 54 days ago from the French port of Toulon, where the vessel was built.

Naval officials said the submarine would be based in Sabah state, on Borneo island, where it will undergo fine-tuning before it is deployed in search and rescue and military exercises.

The two submarines have long attracted controversy since the deal was signed in 2002.

Malaysia's opposition claims that a 540-million-ringgit commission was paid to a close associate of now-Premier Najib Razak in brokering the deal.

The prime minister, who also attended Thursday's ceremony, has denied there was any corruption in the deal, which was made when he was defence minister.

------------------------

The first submarine, KD Tunku Abdul Rahman, is named after Malaysia's first prime minister.

Both submarines can undertake a wide range of missions, including naval blockades, information-gathering and landing or retrieval of commandos.

They can operate alone or in combination with air and sea forces.

The new generation diesel-powered Scorpene has been hailed as a benchmark in the world conventional submarine market.

It is capable of operating in coastal waters and the high seas. It is armed with wire-guided torpedoes and Exocet SM39 sub-launched, anti-surface-ship missiles.

Malaysia is the second customer for the vessel after Chile, while India is acquiring it under a slightly different deal since it is building it in its own dockyard under licence.

Four Kampung Buah Pala Houses Demolished In Third Attempt

Residents and their supporters stand off with riot police as they tried to prevent a demolition team from pulling down their homes

Plans foiled: Villagers being prevented from entering the state administration office at Komtar yesterday.

-Police personnel trying to restrain angry Kg Buah Pala residents on Thursday.

Police detained 18 people, including three women and the villagers' lawyer Dharshan Singh.

The tractors finally moved in and four houses came down.

It was D(emolition)-Day again at Kampung Buah Pala on Thursday with the villagers realising it would be futile to stop their houses from being torn down.

They, however, managed to take out their frustrations at developer Nusmetro Ventures Sdn Bhd director Gary Ho over how many houses would be demolished.

Policemen had to escort workers from house to house to carry out the demolition as earlier the villagers blocked tractors from entering the village.

Below is an account of what transpired:(Source the star)

2.02pm: Workers and light strike force team start to leave village. Only three houses and one room of the fourth house were demolished.

1.50pm: Gary Ho says that only four houses will be demolished today while the rest would be demolished in the coming week.

1.20pm: Workers move on to house No 481, which has been vacated. The owner allows them in without incident.

All three houses were vacated by the owners earlier.

Demolition work starts on the fourth house 473 where the residents have not vacated.

Only a room located outside the house has been torn down.

1.16pm: Workers move out of house No 486, stopping to break down the gate with sledge hammers on their way out. Third house to be demolished now.

1.03pm: The rain peters out to a slight drizzle.

12.58pm: They arrive at House No 486 and workers begin demolishing the house.

12.55pm: Police and the light strike force advance up the road, escorting demolition workers. They meet little resistance because of the rain.

12.50pm: Heavy rain begins, curious onlookers disperse. Those who remain are mainly police and media.

12.45pm: Police stay put on road to village while residents retreat into the village.

12.40pm: At least 14 people were detained including lawyer Darshan Singh and three women.

Light strike force team escorting court officials was obstructed by the people.

12.30pm: The villagers, supporters and MIC youth members are lining up at the entrance of the village obstructing the light strike force team.

One person has been detained by police for obstruction.

12.20pm: Villagers release goats and gather to block the entrance chanting anti-DAP slogans as they blame the state government for their demolition.

12.10pm: Crowd gets restless as police try to restore order. They start chanting “developer balik” as their representatives, developer and bailiff hold discussions in police mobile station on more demolitions.

Villagers’ lawyer Dharshan Singh arrives telling the crowd that the developer has no right to demolish the houses and the crowd gets more worked up.

11.20am: While demolition of house number 467 continues, other villages who fear their homes would be demolished next, appeal to Thomas Chan who is standing outside a mobile police station to save their homes.

10.36am: House 467 is believed to be demolished as sounds of house being broken can be heard by press members who are barred from entering the village.

10.31am: Police lead five contractors with sledgehammers into the village to house number 467 to demolish it.

10.20am: Police discuss with Sugumaran and resident association assistant secretary C. Tharmaraj and urged villagers to keep to their word given to the developer.

The police also asked MIC youth chief T. Mohan to stop party youth members from creating further fracas such as stopping the tractors.

10.15am: Gary Ho is rescued by the police.

10.10am: Tractors start to move in after several villagers agree for the developer to help in the demolition works.

However, due to ignorance about an agreement made to demolish the houses, some other villagers and supporters tried to stop the tractors.

Some also wanted to attack Gary Ho. The police light strike force steps in to maintain order.

10.07am: Villagers outside house number 467 come to an agreement with the police on the demolition.

Still unclear who will break the houses as the police ask reporters to leave the area.

9.55am: Nusmetro director Gary Ho arrives with house keys. He appeals to the residents not to delay the demolition process.

Residents and developer are still debating on who should conduct the demolition of the two houses.

9.30: Sugumaran said the villagers want to demolish the two houses themselves.

They marched to the houses. Villagers and supporters blocked the press entering the village and a scuffle breaks out.

9.20am: Kampung Buah Pala Residents Association chairman M. Sugumaran met Nusmetro Venture executive director Thomas Chan and later informed the press that two families had agreed for their homes to be demolished as they had accepted compensation and handed over their house keys to the developer.

8.30am: Two mobile police stations and three police vans arrive at Kampung Buah Pala.

Demolition of houses stated to take place today.

7.30 am: MIC youths and residents line-up to block entrance.

More than 20 contractors with hammers and crowbars ready to move into the village.

---------------------

The highly controversial eviction of Kampung Buah Pala villagers started today as developer Nusmetro Venture (P) Sdn Bhd moved in to tear down houses of owners who had agreed to relocate.

The demolition job started with a house whose owner had accepted compensation in the form of an alternate house and a relocation cost. The owner voluntarily handed over his house keys to the developer.

Under the watchful eye of the police and the residents association committee, the demolition team moved in to tear down this house. Some hours later, a second house was also torn down.

Spiderman , French Free style Climber conquer Petronas Tower , fined rm2000

French climber Alain Robert, sometimes known as 'Spiderman', has scaled the 88 story Tower Two of the Petronas Towers in Kuala Lumpur, Malaysia. The 47 year old Frenchman has climbed many of the tallest buildings around the globe, all of them without any safety equipment.

This was the third attempt by Robert in scaling the Petronas building following two failed attempts in which he was arrested prior to reaching the top. He began his climb before dawn reaching the top of the 452 meter tower at around 07:30 local time. As he stood on top one of the two pillars helicopters flew around the skyscraper as Robert raised his arms in victory.

Robert was reported to have been detained by Malaysia police as he went back into the building on the 88th floor. Kuala Lumpur police chief Muhammad Sabtu Osman said he could be charged with criminal trespass. "He climbed the building without a permit from the management," he told the AFP news agency.

He has climbed more than 70 buildings and suffered several serious falls over the years. Amongst the buildings climbed are the Eiffel Tower in Paris, the Golden Gate Bridge in San Francisco and the Taipei 101 in Taiwan. He has been arrested countless times, fined and even jailed. In 2007, after scaling the 88-storey Jin Mao Building in Shanghai, he was arrested and jailed for 5 days before being expelled from China

Before today's feat Robert told reporters, "Climbing the Petronas all the way to the top is one of my dreams."

A French climber nicknamed "Spiderman" has been fined £352 for climbing Malaysia's iconic 88-storey Petronas Towers.

Alain Robert was held in custody overnight before pleading guilty to criminal trespass in a Kuala Lumpur court.

was arrested immediately after he had scaled Tower 2 and unfurled a Malaysian flag at the 1,483ft pinnacle on the country's national day.

The 47-year-old took just over two hours to reach the top after setting off in darkness before dawn to avoid the building's security.

Magistrate Siti Shakirah Mohtaruddin let him off with a fine of RM2,000 in place of two months behind bars, over-ruling the public prosecutor's push for a harsher punishment to deter others from following in the freelancing Frenchman's footsteps.

“Taking into consideration this is the first time offending and no previous conviction, no custodial sentence is imposed,” she ruled.

Kg Buah Pala residents seek police protection as deadline passes

holding up banners as part of their hunger protest yesterday.

Twenty-three families in Kampung Buah Pala who are supposed to vacate their houses handed a memorandum to the police on Tuesday, seeking assurance of their safety in the village.

The two-page memorandum was handed over by Kampung Buah Pala Residents Association chairman M. Sugumaran to the Head of Management of the Penang police headquarters, ACP Zakeri Kamaruddin, at 10.30am.

Sugumaran said the residents had sought police assurance of their safety as they were firm on staying in the village until a consensus was reached between the residents and the developer.

"Chief Minister Lim Guan Eng's attitude towards this issue has left us in a lurch.

"We want to move but refuse to do so due to the loose offer and unkept promises by the developer. Until the problem is solved, we won't budge," he told reporters after handing over the memorandum, here.

Meanwhile, Penang acting police chief Datuk Tun Hisan Tun Hamzah refuted the allegations that the police favoured the developer and the state government in the issue.

The majority of the villagers, about 300 ethnic Indians, have resisted all attempts by the developer to get them out. They have even threatened to go on a hunger strike on Tuesday.

All is quiet at the village with a few residents keeping vigil at the entrance, local online reports said.

The Kampung Buah Pala villagers will have to vacate their land by Wednesday following the Federal Court's decision on August 20 which rejected the appeal of the 23 families to stay on the prime land.

The developer had failed in its two attempts to demolish the village due to protests by the affected families.

Nusmetro Ventures (P) Sdn Bhd executive director Thomas Chan had said the company would take vacant possession of the land any time after September 1.

The developer had offered the residents a double storey house in return of their vacating the premises. However, most of them have rejected the offer.

Chief Minister Lim Guan Eng says the state government had nothing to do with the recent arrest of three Kampung Buah Pala residents committee members.

Lim said he did not control the police, and thus had no knowledge of why they were detained.

“Since the residents have sought the help of Umno, they should ask Umno for an explanation.

The state government has no idea about any action taken by the police (against them),” he said after visiting a Merdeka baby at KPJ Penang Specialist Hospital in Bandar Perda here Monday.

On Saturday, police detained the committee’s chairman M. Sugumaran, secretary J. Steven and assistant secretary C. Thamaraj at about 10pm on grounds of criminal intimidation.

They were arrested over an Aug 4 police report lodged against them by several contractors who claimed that the three men had threatened them.

Lim said it was clear that there was an attempt by certain quarters to undermine the state government.

“But, I am certain they will not succeed because the people of Penang are solidly behind the Penang state government.

The villagers had been locked in a protracted battle to save their homes from being demolished after the land was sold to Koperasi Pegawai Kerajaan Pulau Pinang (KPKPP) by the previous state government.

After the villagers lost a court battle against the sale of the land, Nusmetro, under pressure from the Pakatan Rakyat state government to reach an amicable settlement, offered link houses to the residents.

But many of the villagers rejected the offer, and claimed the agreement presented to them by Lim was full of loopholes and placed them at a disadvantage.

Chief among the restrictions was that the residents were required to drop all legal action filed against the landowner, KPKPP, and relevant parties, and to refrain from filing any new suits.

The agreement would also be automatically cancelled if the project was not approved by the authorities, putting residents at risk of being left high and dry.

Lim however has dismissed the concerns, saying the clauses are part of a “standard agreement.”

What Penang People feel now?
Public sentiment has clearly turned against the residents of Kampung Buah Pala and they know it.

Any sympathy for the community, which trace their roots back to the colonial Brown Estate over 150 years back, was lost after news spread that they had rejected an offer for double stories houses from developer, Nusmetro Ventures (P) Sdn Bhd.

However residents claim they were being given a raw deal and have been unfairly maligned in the press.

Why reject the link house deal by the developers?

Draviam Arul Pillai, the oldest surviving villager whose father was first brought to Kampung Buah Pala in the 1920s by the Brown family ,acknowledged himself they had no documents giving them rights over the land.

But he said he refused to take the offer because no mention was made about when and where the new houses would be built or what would happen to the villagers in the meantime.

“There was nothing in black and white, all we had were promises.” He said, insisting that he would have taken the deal if it was more concrete.

He argued that today’s DAP government could be gone tomorrow and there was nothing in the document to ensured the houses would be built.

Besides a brief description on size of the houses, there was little else in the offer letter.

There was also a requirement for the villagers to drop all their legal claims while the houses would be built subject to approvals from the local government, failing which the villagers would have no legal recourse.

The concerns of the villagers were relayed to the state government after the offer by Sungai Siput MP Dr Jeyakumar Devaraj.

When contacted Dr Jeyakumar said the concerns of the villagers were legitimate and not unreasonable.

“They wanted safeguards because the company could go bust and then they would be left with nothing.”

Who resposible for this problem face by Kg Pala people?

Originally Brown family in 1920s bought in the Kg Pala people here to management the estate.Later the land was given to the government of that time and the people are issued Temporary Occupation License. However , under the BN government Tun Koh Tsu Koon sold off the land and let the developer deal with the settlements.

Draviam blames both the present and past state governments for the dilemma but is more bitter with the DAP, who he said had made the plight of the village an election issue.

“We had always supported BN until they sold our land so we voted for the opposition because they promised to help us, but they have forgotten this,” he said.

He also lashed out at the MIC as well as other political parties and Non Government Organisations (NGO) which he said were trying to get political mileage but have done nothing to solve their problem.

MCA veteran Tan Sri Lee Kim Sai said today the MCA can "kill two birds with one stone" by having one extraordinary general meeting (EGM) to deal with the current turmoil in the party. He said the EGM could deal with the issue of confidence in the leadership of party president Datuk Seri Ong Tee Keat and the recent sacking of Datuk Seri Dr Chua Soi Lek from the party at the same sitting.

"No need to have two EGMs. Just one is enough, with these two agendas. One is for the vote of confidence and the other on Dr Chua. Let the delegates decide," he told Bernama today.

MCA has decided to have only one extraordinary general meeting (EGM) and delegates were told to submit their agendas to the party headquarters by Friday.

The directive came from party secretary-general Datuk Wong Foon Meng, who said this was to avoid too many meetings which will cause unnecessary inconvenience to delegates.

● Wong said MCA will start preparing for the EGM after Friday, including sending out notices.

● Both vice-president Datuk Seri Liow Tiong Lai and Youth Chief Datuk Dr Wee Ka Siong have voiced their agreement for a single EGM.

● Liow has also denied that the present issue is a repeat of the 1984 party crisis involving the then leaders.

● Former deputy president Datuk Seri Dr Chua Soi Lek wants to go ahead with his supporters’ plan for their own EGM.

Datuk Seri Dr Chua Soi Lek, who was sacked as MCA deputy president by the MCA presidential council over his DVD sex scandal last week, had described Ong’s move to call the EGM as a “blatant use of executive power”.
“It was the grassroots who first started the ball rolling in
petitioning for an EGM. Ong’s move in calling another EGM
is aimed at confusing the members.”

Ong made the surprise move in calling the EGM on Monday under Article 30.1 of the party’s constitution to allow members to reflect on the direction in which the party should be heading.

He said president Datuk Seri Ong Tee Keat's decision showed a lack of consistency in his leadership.

"When I was sacked and there was talk of my supporters having an EGM, the president's supporters criticised and condemned it.

"Now, hardly three days later, Ong decides to have an EGM. His whole motive is to confuse the delegates," he told the New Straits Times yesterday.

Chua said he will leave it to the political maturity of the delegates to decide on the future direction of the party. "They are clear as to what the president should do and shouldn't do."

He also took a swipe at the party's leadership, including the disciplinary board's recommendation that he be expelled due to his involvement in a sex scandal as it would be a burden to the party.

"If I am a burden to the party, then the grassroots should be happy with the decision.

"Why has it evoked such strong protests from members that the leadership is forced to go on a nationwide briefing to explain the situation?"

He added he had not decided whether to appeal against his sacking, saying that he needed more time to consider his options.

Upon arrival at the party's headquarters in Jalan Ampang Chua Soi Lek was asked to predict how the presidential council meeting would go, he replied by grabbing his throat with his hand and said, "Gantung mati" (hanged to death) thrice in succession.

Chua was not allowed to participate in the meeting as he was an interested party.

He said he had received a report from the disciplinary committee which recommended the presidential council to sack him.

He added that he will adhere to whatever decision made by the party on the matter.

He noted that the presidential council usually endorsed decisions made by the disciplinary committee.

He also said that he hoped party president and his rival Ong Tee Keat will "sleep well tonight after I'm expelled".

He said that Ong had been seeing him as an enemy and the biggest threat since party elections last October.

"Members must take necessary action to stop the party from being destroyed by one person," he said.

Pakatan asks court to quash police ban in Ipoh. Failed. But will continue the seating inside State Secretary.

KUALA LUMPUR, Sept 2 — In a race against time, Perak’s Pakatan Rakyat (PR) faction will be rushing to the Ipoh magistrate’s court at 8am today to set aside another court order barring the public from going near the state secretariat building, ahead of its scheduled assembly sitting at 10am.

Ousted Perak speaker, V. Sivakumar who fears interference from the state secretary, says he is committed to holding an assembly sitting inside the state secretariat building in Ipoh tomorrow.

“I'll go ahead with it,” he told The Malaysian Insider over the phone this evening.

Sivakumar had failed in his bid to get the Ipoh High Court to issue a restraining order against Datuk Abdul Rahman Hashim earlier this afternoon.

According to PR’s calculations, the assembly must sit tomorrow or be automatically dissolved. Perak’s Constitution provides for only a six-month gap between sittings.

Sensing trouble, state police chief, Datuk Pahlawan Zulkifli Abdullah, succeeded in getting a court order under Section 98 of the Criminal Procedure Code to block anyone from going within 30 metres of the fence encircling the state government headquarters at Ipoh’s Jalan Panglima Bukit Gantang Wahab from 1am today until 11pm tomorrow.

He said the police had obtained a court order under Section 98 of the Criminal Procedure Code to prohibit anyone from attending the ‘sitting’ or being within a 30-metre radius from the building, beginning 1am on Sept 2 till 11pm, the following day.

“The police have been informed by the state government that there is no state assembly sitting scheduled for Sept 2,” he said in a statement here today. Zulkfili said the matter had also been verified by Perak State Assembly Speaker Datuk R. Ganesan.

“The order seems to prohibit supporters from gathering but not elected reps,” ousted DAP state executive councillor Datuk Ngeh Koo Ham told The Malaysian Insider last night when contacted.

“This should rightly be so as Article 72 of the Federal Constitution prohibits courts from interfering with the affairs of the Legislature,” he added.

But Ngeh lashed out at the police force for the public institution’s seemingly all-too speedy action in kow-towing to BN.

The Perak DAP chief expects the police to stop PR assembly members from going into the state secretariat.

And he pointed out that anyone who blocks a lawmaker from carrying out his duties can be jailed up to seven years under Section 124 of the Penal Code.

The previous Perak Assembly Speaker Sivakumar were forcefully stripped from his robe and manhandlled to vacate the Assembly Speaker seat.

New Perak Speaker R. Ganesan stands accused of holding another job besides being the Speaker of the state assembly. Another battle is raging over Datuk R. Ganesan’s validity as the Perak Speaker, with Pakatan Rakyat leaders here claiming he should be disqualified for holding two jobs — as Speaker and as a lawyer.Ganesan has, however, denied this and claims he had stopped his practice since his appointment during the chaotic May 7 state assembly sitting. The Bar Council has clarified that Perak Speaker Datuk R Ganesan had only filed a notice of cessation of practice as a lawyer on August 17, ten days after a statutory deadline for him to do so expired.A letter to the Bar Council which was received on August 17 was however dated August 6.

The actual “Notice of Cessation of Practice as an Advocate and Solicitor” was only field on August 17, as was an accompanying statutory declaration.

Last week, former mentri besar Datuk Seri Mohammad Nizar Jamaluddin revealed that the former Sungkai assemblyman had infringed Article 36A of the Perak Constitution by failing to relinquish his job as a lawyer within three months of his appointment.

Bar Council secretary George Varughese said in a statement today the Bar Council had acknowledged receipt of Ganesan’s letter dated August 6.

But he pointed out that the “Notice of Cessation” was dated August 17.

In the statement, Varughese said Ganesan had faxed a letter to the Bar Council on August 13, six days after the deadline expired, claiming that he had ceased being a lawyer on August 6.

But the notice of cessation remained dated August 17, ten days after the legal deadline.

The Bar Council statement appears to back Perak PR lawmakers in their argument that Ganesan had breached the state constitution and could no longer be Speaker.
